HEALTH CARE LAW – HOW DOES IT IMPACT YOU

If you have children who have been declined in the past with pre-existing conditions, the pre-existing requirement will be eliminated for all health insurance plans.  All children will be guaranteed issues come September 23rd 2010.

Elimination of lifetime and “unreasonable” annual maximums will be implemented this year. Each insurance company will have to obtain clarity on the law and adjust or drop plans that are not in compliance. Some “limited” health insurance plans presently have an annual maximum of $25,000 or $50,000.  AETNA ‘s “limited” plans will no longer be available after July 1st. If you have a “limited” plan now, contact us and we will assist to find you another health insurance plan. As with any federal law the legislative language requires clarity to implement.

Health Care Reform Implementation - II

It may be surprising to learn that the Patient Protection and Affordable Care Act of 2010 (PPACA), despite being 2,409 pages long, defines most of its provisions broadly – in many cases, it lacks the definition necessary to interpret and implement the law. In fact, the phrase, “The Secretary shall” appears 1,045 times in the law, indicating that the Department of Health and Human Services (HHS) must provide clarification and additional detail.

The federal government is beginning to issue its draft regulations and guidance. Guidance issued to date (or expected very soon) includes topics such as the HHS Web portal, the early retiree reinsurance program, grandfathering, and pre-existing condition exclusions for children. Insurance companies will be analyzing these new regulations thoroughly to determine the impact to their members, and we will adjust their working hypotheses as appropriate. In the meantime, filings for the Department of Insurance (DOI) will be prepared for submission by insurance companies.

As each insurance company obtains clarification, we will see new, modified and cancelled health insurance plans. My advice is to get a plan that best meets your needs NOW. If you have a plan, keep it. As the new plans come out, we will be prepared to present those to you.
